Client Brochures

The Ohio Association of REALTORS has created several brochures to distribute to your buyers and sellers. They are available in PDF format. In order to view and print these brochures you must have Adobe Acrobat Reader 4.0 (free download button is provided).

Waiver of Duties Statement — On Oct. 9 OAR’s-sponsored minimum service license law provisions take effect. This law clarifies that the fiduciary duties owed a client cannot be waived. However, it does allow a client to waive a licensee’s obligation to perform the specific duties provided in ORC 4735.63 and 4735.65 which are owed to a buyer or seller.

In order to obtain a client’s waiver of a specific duty(s), a new Waiver of Duties form must be executed.

Agency Disclosure Statement — As required by Ohio law, this form is distributed by real estate agents to their clients and customers. This form provides assistance in understanding the role of other agents whom may be involved in the transaction. Revised Jan. 1, 2005.

Seller Disclosure — Geared to buyers and sellers, this pamphlet explains the Seller Disclosure form; when to use the form; provisions for delivering the form; and rights of rescission and enforcement.

Your Home Inspection — Also geared to buyers and sellers, this pamphlet contains information on the home inspection process; choosing a home inspector; inspection fees; common maintenance problems; and specific advice for buyers.

Residential Lead Based Paint Disclosure form — To protect families from exposure to lead from paint, dust and soil, Congress passed the Residential Lead-Based Paint Hazard Reduction Act of 1992. This law directed HUD and EPA to require the disclosure of known information on lead-based paint and lead-based paint hazards before the sale or lease of most housing built before 1978.

Type of housing covered
Most private housing, public housing, Federally owned housing, and housing receiving Federal assistance are affected by this rule.

Effective dates
The regulations became effective in 1996 for transactions involving owners of 1 to 4 residential dwellings.
